We Warmly Welcome you to Ezstudy.lk!

Ezstudy.lk mission is to improve lives through learning. We enable anyone anywhere to create and share educational content (instructors) and to access that educational content to learn (students). We consider our marketplace model the best way to offer valuable educational content to our users. We need rules to keep our platform and services safe for you, us, and our student and instructor community.

These Terms apply to all your activities on the Ezstudy.lk website, the Ezstudy.lk mobile applications and other related services (“Services”). If you publish content on the Ezstudy.lk platform, you must also agree to the Instructor Terms. We also provide details regarding our processing of personal data of our students and instructors in our Privacy Policy.

Ezstudy.lk is operated by Easy Technologies Pvt Ltd which is registered in Sri Lanka under the business registration number PV 00238701 bearing address No 5, Shramadana Mawatha, Rawathawattha, Moratuwa, Sri Lanka. The User acknowledges that all statements related to Ezstudy.lk should be addressed to, via e-mail address: info@ezstudy.lk

License

Easy Technologies Pvt Ltd grants you a revocable, non-exclusive, non-transferable, limited license to use the Ezstudy.lk LMS web platform strictly in accordance with the terms of this Agreement.

These Terms & Conditions are a contract between you and Easy Technologies Pvt Ltd (referred to in these Terms & Conditions as “Easy Technologies Pvt Ltd “, “us”, “we” or “our”), the provider of Ezstudy.lk and the services accessible from the Easy Technologies Pvt Ltd website (which are collectively referred to in these Terms & Conditions as the “Easy Technologies Pvt Ltd Service”).

You are agreeing to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, please do not use the Ezstudy.lk services provided by Easy Technologies Pvt Ltd Service. In these Terms & Conditions, “you” refers both to you as an individual and to the entity you represent. If you violate any of these Terms & Conditions, we reserve the right to cancel your account or block access to your account without notice.

Definitions and Key Terms

​To help explain things as clearly as possible in this Terms & Conditions, every time any of these terms are referenced, are strictly defined as:

“Ezstudy.lk” means the web platform interface developed by Easy Technologies Pvt Ltd that provides LMS services, in order to use our services, we collects non-personal information and personal data from Users.

“Users” refers to the company, organization or person that is registered with Ezstudy.lk to use the Services. Whenever the term “you” is mentioned, we will be referring to Ezstudy.lk Users, who are consenting to this Terms & Conditions/Privacy Policy and whose non-personal information and / or personal data are used by Ezstudy.lk.

“Service” refers to the service provided by Ezstudy.lk.

“Easy Technologies Pvt Ltd”, when this policy mentions “Company,” “we,” “us,” or “our,” it refers to Easy Technologies Pvt Ltd, developer of Ezstudy.lk, to which this Terms & Conditions applies.

“Cookie” refers to the small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, and remember information about you such as your language preference or login information.

 “Third-party service” refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you

Account

You need to create an account for activities on our platform, including to purchase and access content or to submit content for publication. When setting up and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission. This means you need to be careful with your password. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, the account of that user will be closed.

You may not share your account login credentials with anyone else. You are responsible for what happens with your account and Ezstudy.lk will not intervene in disputes between students or instructors who have shared account login credentials. You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting us at support@ezstudy.lk . We may request some information from you to confirm that you are indeed the owner of your account.

Students and instructors must be at least 18 years of age to create an account on Ezstudy.lk and use the Services. If you are younger than 18 but above the required age for consent to use online services where you live, you may not set up an account, but we encourage you to invite a parent or guardian to open an account and help you access content that is appropriate for you. If you are below this age of consent to use online services, you may not create a Ezstudy.lk account. If we discover that you have created an account that violates these rules, we will terminate your account.

Using Ezstudy.lk at Your Own Risk

Our platform model means we do not review or edit the content for legal issues, and we are not in a position to determine the legality of content. We do not exercise any editorial control over the content that is available on the platform and, as such, do not guarantee in any manner the reliability, validity, accuracy, or truthfulness of the content. If you access content, you rely on any information provided by an instructor at your own risk.

By using the Services, you may be exposed to content that you consider offensive, indecent, or objectionable. Ezstudy.lk has no responsibility to keep such content from you and no liability for your access or enrolment in any course or other content, to the extent permissible under applicable law. This also applies to any content relating to health, wellness, and physical exercise. You acknowledge the inherent risks and dangers in the strenuous nature of these types of content, and by accessing such content you choose to assume those risks voluntarily, including risk of illness, bodily injury, disability, or death. You assume full responsibility for the choices you make before, during, and after your access to the content.

When you interact directly with a student or an instructor, you must be careful about the types of personal information that you share. While we restrict the types of information instructors may request from students, we do not control what students and instructors do with the information they obtain from other users on the platform. You should not share your email or other personal information about you for your safety.

We do not hire or employ instructors nor are we responsible or liable for any interactions involved between instructors and students. We are not liable for disputes, claims, losses, injuries, or damage of any kind that might arise out of or relate to the conduct of instructors or students.

When you use our Services, you will find links to other websites that we don’t own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. You should also read their terms and conditions and privacy policies.

No Academic Credit

Unless otherwise explicitly indicated by a credit-granting institution, participation in or completion of Content Offerings does not confer any academic credit. Even if credit is awarded by one institution, there is no presumption that other institutions will accept that credit. You agree not to accept credit for completing a Content Offering unless you have earned a course certificate or other equivalent documentation of your completion of the Content Offering. Ezstudy.lk, instructors, and the associated Content Providers have no obligation to have Content Offerings recognized by any educational institution or accreditation organization.

User Postings Representations and Warranties

By submitting or distributing your User Postings, you affirm, represent, and warrant

1. that you have the necessary rights, licenses, consents, and/or permissions to reproduce and publish the User Postings and to authorize Ezstudy.lk and its users to reproduce, modify, publish, and otherwise use and distribute your User Postings in a manner consistent with the licenses granted by you below, and
2. that neither your submission of your User Postings nor the exercise of the licenses granted below will infringe or violate the rights of any third party. You, and not Ezstudy.lk, are solely responsible for your User Postings and the consequences of posting or publishing them.

License Grant to Ezstudy.lk and the Members

By submitting or distributing your User Postings, you hereby grant to Ezstudy.lk and the Members a worldwide, non-exclusive, transferable, assignable, sub licensable, fully paid-up, royalty-free, perpetual, irrevocable right and license to host, transfer, display, perform, reproduce, modify, distribute, redistribute, relicense, and otherwise use, make available, and exploit your User Postings, in whole or in part, in any form and in any media formats and through any media channels (now known or hereafter developed).

Third-Party Sites, Products and Services; Links

The Services may include links or references to other web sites or services solely as a convenience to Users (“Reference Sites”). Ezstudy.lk does not endorse any such Reference Sites or the information, materials, products, or services contained on or accessible through Reference Sites. ACCESS AND USE OF REFERENCE SITES, INCLUDING THE INFORMATION, MATERIALS, PRODUCTS, AND SERVICES ON OR AVAILABLE THROUGH REFERENCE SITES, IS SOLELY AT YOUR OWN RISK.

Security

We care about the security of our users. While we work to protect the security of your account and related information, Ezstudy.lk cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account by emailing privacy@ezstudy.lk

Governing Law

The Services are managed by Ezstudy.lk, which is in Moratuwa, Sri Lanka. You agree that any dispute related to these Terms will be governed by the laws of Sri Lanka, excluding its conflicts of law provisions.

Translations

Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language will control if there is any conflict.

Trademarks

While you are a published instructor and subject to the requirements below, you may use our trademarks where we authorize you to do so.

You must: only use the images of our trademarks that we make available to you, as detailed in any guidelines we may publish; only use our trademarks in connection with the promotion and sale of your Submitted Content available on Ezstudy.lk or your participation on Ezstudy.lk; and immediately comply if we request that you discontinue use.

You must not: use our trademarks in a misleading or disparaging way; use our trademarks in a way that implies that we endorse, sponsor, or approve of your Submitted Content or services; or use our trademarks in a way that violates applicable law or in connection with an obscene, indecent, or unlawful topic or material.

Suspension and End of Services

Service Provider has the right to conduct maintenance works intended for the restoration of safety and stability of the computerized system. User has no right to claims in connection with such break or cease to render Services by the Service Provider. Service Provider may also permanently cease rendering Services;

A) Ezstudy.lk may suspend, restrict, or terminate the provision of the Services (in whole or in part) and/or close your Account without informing you and without any liability whatsoever (although, we will, where possible, try to inform you that such action is or may be taken) under the following circumstances:

• If Ezstudy.lk is aware or has reason to believe that your account with us used in relation to the platform services is/are being used in an un-authorized, unlawful, improper or fraudulent manner or for criminal activities (or has been so used previously);
• If you do not comply with any of the conditions relating to the Instructor Rules including these Terms & Conditions of Use;
• If you notify us that your account credentials has been disclosed to or accessed by, any other party;
• for reasons outside of our control;
• where we close your Account under Clause B

B) To access the Ezstudy.lk platform Services, your account must be operational regularly. If your account is inactive for a consecutive period of 12 months, your Ezstud.lk Account as well as any credit balance in the account will be archived by Ezstudy.lk and you can have access to the money by reactivating your account with technical support after the verification processes

• Ezstudy.lk will also close your Account upon receipt of your request to close your Account
• We will not be responsible to you for any direct, indirect, consequential, or special damages arising from any act or omission by us or any third party for whom we are responsible, whether arising in contract, or statute, if we close or suspend your Account in terms of this clause

Disclaimers

THE SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE EZSTUDY.LK PARTIES SPECIFICALLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. THE EZSTUDY.LK PARTIES FURTHER DISCLAIM ANY AND ALL LIABILITY RELATED TO YOUR ACCESS OR USE OF THE SERVICES OR ANY RELATED CONTENT. YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THE SERVICES OR SUCH CONTENT IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE EZSTUDY.LK PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY PARTY OTHER THAN THE APPLICABLE EZSTUDY.LK PARTY, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION. IN NO EVENT SHALL EZSTUDY.LK’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED FIVE THOUSAND RUPEES (LKR5000.00) OR THE TOTAL AMOUNT OF FEES RECEIVED BY EZSTUDY.LK FROM YOU FOR THE USE OF PAID SERVICES DURING THE PAST SIX MONTHS, WHICHEVER IS GREATER.

YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH IN THIS TERMS OF USE REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND THE EZSTUDY.LK PARTIES, AND THAT THESE LIMITATIONS ARE AN ESSENTIAL BASIS TO EZSTUDY.LK’S ABILITY TO MAKE THE SERVICES AVAILABLE TO YOU ON AN ECONOMICALLY FEASIBLE BASIS.

YOU AGREE THAT ANY CAUSE OF ACTION RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED

Indemnification

You agree to indemnify, defend, and hold harmless the Ezstudy.lk Parties from any and all claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights

Changes

From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and Ezstudy.lk reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means, such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
